Every adult should have a will. A will allows you to direct how your property should be divided when you pass away. A will also permits you to nominate a guardian for your minor children, and may reduce the expenses of administering your estate. In some cases, you may also be well-served by establishing a "living trust." I will take the time to understand your needs and desires and help you make the right decision for you and your family.
A general Power of Attorney allows you to appoint a person to handle your financial affairs if you are unable to do so. You may want a medical power of attorney, which allows a trusted person to make medical treatment decisions on your behalf if you are unable to do so. A living will allows you to express your preferences on end-of-life decisions. This allows your wishes to be carried out, and also relieves your family from having to make those difficult decisions on their own.
You may need a deed to transfer property, or a contract drafted for any number of reasons. You may wish to form an LLC or a corporation to start a new business or to protect your property. I am always happy to help by drafting the necessary documents.
Who needs a will? Every adult needs a will. A will not only allows you to determine what happens to your property when you pass away, but it also allows you to name the person responsible for handling your estate and permits you to nominate the person who you would like to care for your minor children. Without a will, the court will make these important decisions, and those decisions may not be the same as your wishes.
Is it difficult to get a will? Not at all. The process starts with you answering some written questions. Then we sit down and talk about your family, your wishes, and how best to make your wishes become a reality. Once we do this, your will is prepared in draft form and changes are made if necessary.
Can my family avoid probate? "Probate" is a court procedure where your will is proven to be valid, and your estate is administered. Many people want to avoid probate for a variety of reasons. If you want your family to be able to avoid probate, a trust may be a viable alternative for you. There are also other strategies that can help your family avoid the probate process.
